The Right Honourable The Earl of Elgin and Kincardine, K.G.,
G.C.S.I., G.C.I.E.
H.B.M. Secretary of State for the Colonies.

My Lord,

We have the honour to bring to your Lordship's notice the following facts and circumstances :-

On the 22nd February 1906 an action was commenced by our firm as Solicitors for and on behalf of Lam Sin Shang and She Wai Chung, Chinese Merchants carrying on business in this Colony, against one O Yik Tong, a resident of the neighbouring Portuguese Colony of Macao, in respect of a cause of action which arose within this Colony.

Service of the Writ of Summons was accepted, and appearance was entered for the Defendant by his Solicitors in this Colony, pleadings were filed, and eventually the action came on for trial on the 15th May 1907, when the Defendant, who was represented at the trial by his Solicitors and by Counsel, personally attended and gave evidence.

On the 29th May 1907 judgment was delivered for the Plaintiffs in the action for the sum of $13,165.27 and costs.

It was then found that, though the Defendant was formerly possessed of property in this Colony, he had disposed of it all, and that satisfaction of the judgment could not be obtained in Hongkong. It was, however, thought that it would be an easy matter to get the judgment of the Court of this Colony enforced in the Court of the Colony of Macao, in which place the Defendant is possessed of very considerable property; but, upon our giving instructions to a legal practitioner of Macao to take
